The issue of polyamory has sparked debate in Mexico following the Supreme Court of Justice of the Nation's (SCJN) refusal to legally recognize the marital union of more than two people, after a family from Puebla filed for legal recognition of their polyamorous relationship.

 

The SCJN, with a majority of four votes, decided that although its ruling does not prohibit or stigmatize polyamory, it will not legalize marriages or cohabitations involving more than two people in Mexico. The court argued that these relationships should be regulated outside the terms of marriage or cohabitation to avoid possible abuses and distortions, expressing concerns about potential situations of inequality and discrimination, especially towards women, girls, and children, who are part of such families, due to their rarity in Mexican society, according to Minister Jorge Mario Pardo Rebolledo.

 

Federal Judge Pedro Arrollo Soto of Puebla had previously argued that the legislation was discriminatory in restricting the freedom to marry or cohabit with more than one person, also affecting those seeking to formalize a polyamorous family.

 

The SCJN's response indicated that its decision does not necessarily infringe on the freedom of sexual orientation, as many polyamorous relationships are not homosexual, such as a triad formed by two women and one man, even if these women do not have a physical or romantic attraction to each other.

 

What is Polyamory?

 

Polyamory is a type of relationship in which a person may experience sexual or emotional attraction to multiple individuals simultaneously.

 

This concept has gained relevance recently with viral cases, such as that of Dani Flow, who announced that his girlfriend was pregnant alongside his wife and eldest daughter, or that of adult content producer Alex Marín, who maintains relationships with several women.

 

It is crucial to distinguish polyamory from infidelity, as all romantic and sexual practices must be consensual among all individuals involved in the bond.
